SUMMARY:PCMA Canada West Educational Series: Contracts & Negotiations in a Post COVID-19 World
DESCRIPTION:Session led by Tyra Warner\, PhD\, Esq\, CMP \nCOVID-19 is novel in more than just a medical sense. It has made us consider whether and how to modify force majeure and cancellation clauses. Foreseeability is the new buzzword with regard to force majeure and insurance. New issues regarding cleanliness\, service\, and safety call for new contract language. Where we used to want clarity\, now we need flexibility. In this session\, we will discuss how to negotiate the best contracts for existing meetings and for future meetings\, all with the spectre of COVID-19 and an unclear future. \nLearning Outcomes:  \n– Analyze force majeure clauses in the context of COVID-19\, and the uncertain\ntimeline for meetings recovery.\n– Prepare to negotiate for new issues in a post-COVID-19 event setting.\n– Understand how the concept of foreseeability affects the grey area between\nforce majeure and cancellation. \n
